                              (1)
                        W.P. No. 7236/15
(Dr. Vishwanath Prasad Khare Vs. State of M.P. & another)

8/1/2016
Shri C.P.Singh, Advocate for the petitioner.
Shri Praveen Newaskar, G.A. for the respondents-State.

Heard on admission.

This petition, under Article 226 of the Constitution of India, is filed with the grievance that petitioner had incurred an expenditure of Rs.29,448/- towards medical treatment for his wife who had suffered bullet injury on the fateful day of 26/8/13 in her House No. 1306, New Darpan Colony, Thatipur, Gwalior at about 3 p.m. when unknown miscreants had invaded the house forcibly and tied her hands with intention to commit dacoity and murder. The miscreants had looted precious belongings, hard cash and gold ornaments. Due to bullet injury on the neck, petitioner's wife had become unconscious.

It is submitted that petitioner has retired as Dy. Director, Panchayat Department and is entitled for medical reimbursement for the expenditure incurred towards treatment of his wife under the service rules. He has filed detailed representation dated 10/3/14 and thereafter reminder dated 1/10/14 for reimbursement, addressed to respondent no.2, but so far the same has not been adverted to and reimbursement of the amount, as aforesaid, has not been done. Under such circumstances, he has approached this Court for a direction to (2) W.P. No. 7236/15 (Dr. Vishwanath Prasad Khare Vs. State of M.P. & another) respondent no.2 to decide his representation, as early as possible and ensure reimbursement of the amount of medical expenses.

The prayer appears to be reasonable and innocuous in nature.

Accordingly this petition is disposed of with direction that if petitioner approaches respondent no.2 along with copy of his pending representation and certified copy of this order within fifteen days from today, respondent no.2 shall deal with the representation forthwith without further loss of time and take a final decision thereupon within next six weeks and communicate the decision to the petitioner within reasonable time.

With the aforesaid, this writ petition stands disposed of.
