Date: 29-07-2016 Annexure- 14 is the advertisement issued by Bihar Staff Patna High Court CWJC No.11600 of 2016 dt.29-07-2016 10 / 11 Selection Commission. Appointments are going to be made on various posts under ITIs, details of which would be evident from reading of Annexure-14. The petitioners, who are one to many, are all working on contract under the State authorities and their grievance is that despite a resolution of the General Administration Department, having been issued on 21.5.2013, which is resolution No.8025 and is Annexure- 9 to the writ application, the advertisement issued by the Staff Selection Commission does not provide for grant of any weightage to people working on contract.
Since reading of Annexure- 9 does not indicate that it was a case specific or department specific kind of resolution then the policy decision so notified has to be applied across the board by all the departments, which initiate an exercise for filling up post on regular basis, to provide weightage for people working on contract.
The Staff Selection Commission goes by the requisition sent by the department concerned based on which the advertisements are issued. In the present case, therefore, a direction is issued upon the Principal Secretary, Labour Resources Department, Government of Bihar to take cognizance of Annexure- 9 and issue appropriate directive to the Staff Selection Commission as well as notify the decision with regard to such grant of weightage on the website of the Staff Selection Commission. Such a decision must be taken within a Patna High Court CWJC No.11600 of 2016 dt.29-07-2016 11 / 11 period of four weeks from the date of production of a copy of this order.
Writ application is disposed of with the above direction.
