Section 55 in The Bengal Agricultural Income-Tax Act, 1944
55. Prosecution to lie at the instance of Commissioner. -
(1)A person shall not be proceeded against for an offence under section 53 or section 54 except at the instance of the Commissioner.(2)The Commissioner may, subject to such conditions as may be prescribed, either before or after the institution of proceedings compound any such offence.
