WHEREAS the Petitioners above named through their Advocate SRI SREEDHAR VALIVETI presented this Petition under Article 226 of the Constitution of India praying that in the circumstances stated in the affidavit filed therewith, the High Court may be pleased to issue a Writ of Mandamus of any other appropriate Writ declaring the possession notice dt. 17.10.2025 under Sec. 13 (4) of the SARFAESI Act, 2002 issued by Respondents 1 and 2 under SARFAESI Act, 2002, without claiming and settling the liability insurance from Respondents 3 to 5, into the loan account of wife of 1st Petitioner and mother of 2^^ Petitioner i.e., Mrs. Kallam Padma as illegal- arbitrary, improper unjustified and against the law laid down and consequently praying this hon'ble Court to stay of all further proceedings in pursuant to' possession notice dt. 17.10.2025 issued under Sec. 13(4) of SARFAESI Act 2002 issued by the Respondents 1 and 2. ?
AND WHEREAS the High Court upon perusing the petition and affidavit filed herein and upon hearing the arguments of Sri SREEDHAR VALIVETI Advocate for the Petitioners, and of SRI P.RAJESH KUMAR, Standing Counsel for the Respondent No.6, directed issue of notice to the Respondent Nos.1 to 5 herein to show cause as to why this WRIT PETITION should not be admitted.
