The petitioners have filed this petition under Section 438 Cr.P.C. for grant of anticipatory bail in case FIR No.16 dated 17.1.2013 registered at Police Station, City Kapurthala, for the offences under Sections 406, 498-A and 313 IPC.
The petitioners are brother-in-law and sister-in-law (Jeth and Jethani) of the complainant. It is argued by the Learned counsel for the petitioners that the petitioners are residing separately. Main allegations are against the husband of the complainant.
The dowry articles are also not supposed to be in their possession. They have already joined the investigation. The petitioners are not required for custodial interrogation. Keeping in view the facts and circumstances of the present case, I accept the criminal miscellaneous petition and the order dated 5.3.2013 passed by this Court granting interim bail to the petitioners is made absolute. However, the petitioners shall join the investigation as and when called upon to do so and shall abide by the conditions of Section 438 (2) Cr.P.C.
