Order 17/02/2017 Petitioner is craving interim bail by taking shelter of Section 439 Cr.P.C. Presently petitioner is lodged in District Jail, Banswara for offence punishable under Sections 408 & 420 IPC arising out of FIR No.487/2016, which has culminated into Criminal Regular Case No.192/2017. The aforementioned case is pending before Chief Judicial Magistrate, Banswara.
For claiming interim bail, it is, inter alia, submitted by learned counsel that marriage of petitioner's younger brother shall be solemnized on 19th of February, 2017 and requisite programmes for the ceremony are to commence from 18 th of February 2017. It is further argued by learned counsel for the petitioner that being elder brother, presence of the petitioner is necessary during marriage ceremony and therefore, he may be (2 of 2) [CRLMB-1606/2017] enlarged on interim bail for a period of one week. Learned counsel in support of his prayer for interim bail has also placed on record the marriage invitation card.
Learned Public Prosecutor has opposed prayer for interim bail in general. However, learned Public Prosecutor has admitted the fact that marriage of petitioner's younger brother is to be solemnized on 19th of February, 2017.
having regard to the facts and circumstances of the case and taking into account the genuine and good reason shown by the petitioner for interim bail, I feel persuaded to accept this interim bail application.
Accordingly, interim bail application is allowed and the accused-petitioner, Antish Pandwal S/o Shri Vimal Kumar, is ordered to be released on interim bail for a period of four days from the date of release, provided he furnishes a personal bond of Rs.50,000/- with two sureties of like amount including one surety of his brother or sister to the satisfaction of Superintendent, District Jail Banswara. The petitioner is further directed to surrender on or before expiry of four days for which he is being released on interim bail before the jail authorities.
