            WRIT PETITION No.43630 OF 2018

ORDER:

The grievance of the petitioners rests on a narrow compass. Petitioners 1 and 2 are owners of lands admeasuring in an extent of Ac.16-18 guntas having purchased the same under registered sale deeds and their names were also mutated in the revenue records. While so, the Government of Telangana acquired part of their lands in the year 2017 for the purpose of establishment of IT/Multipurpose Industrial Corridor at Yedira village, Mahabubnagar districts. The land acquired from petitioners 1 and 2 is Ac.7-29 guntas and compensation for the same was paid vide consent award dated 31-08-2018 vide proceedings of the 3rd respondent and the same was published in official Gazttee on 14-08- 2018. But, in the consent award passed by the 3rd respondent, due to typographical mistake, the extent of lands acquired is shown as Ac.7-29 guntas from each of the petitioners, whereas in effect only Ac.7-29 guntas was acquired from both of the petitioners and compensation was also paid for the said extent only.

The grievance of the petitioners is that though the petitioners addressed a letter dated 15-11-2018 to the 3rd 2 respondent to rectify the typographical mistake and sought for correction thereof, no action is being taken till now and in view of this discrepancy, the 4th respondent is also not issuing new pattadar pass books for the remaining lands of the petitioners, after deducting the lands acquired. Hence, this writ petition.

3. Heard learned counsel for the petitioners and learned Assistant Government Pleader for Revenue.

4. It is the case of the petitioners that the lands to the extent of Ac.7-29 guntas were acquired and compensation was paid for that extent only. In those circumstances, the consent award cannot reflect that Ac.7-29 guntas of land from each of the two petitioners is acquired, due to which the 4th respondent is also not taking any steps for issuance of pattadar pass books for the remaining lands.

In the circumstances, the writ petition is disposed of directing the 3rd respondent to take action on the letter dated 15-11-2018 addressed by the petitioners for correction of the typographical mistake within a period of six weeks from the date of receipt of a copy of this order and on such correction and on subjective satisfaction, the 4th respondent to issue pattadar pass books in favour of the petitioners for the remaining 3 extent of lands, within a period of four weeks thereafter. There shall be no order as to costs. As a sequel to the disposal of this petition, miscellaneous petitions, if any, pending shall stand closed.
