Kausik (Rejected) CRM (NDPS) 1682 of 2025 In Re: An Application for Bail under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023/ Section 439 of the Code of Criminal Procedure, 1973 in connection with N Case No. 270/25 arising out of F.No. SI (VII)-237/2025 (AIU) dated 22.10.2025 under section 20(b) and section 23(a) read with section 8 of the NDPS Act, 1985.

Mr. Angshuman Chakraborty Mr. Shashanka Shekhar Saha ......for the Petitioner.

Mr. Bhaskar Prosad Banerjee Ms. S. Sinha ......for the Customs Authority. Learned advocate appearing for the petitioner submits that the petitioner is in custody since 22.10.2025 and the quantity of contraband so seized is of intermediate quantity.

Learned advocate for the Customs Authority opposes the prayer for bail.

On an assessment of the records I find that the issue relating to intermediate or commercial quantity is not important in this case. What I find, the Calcutta Airport is used for the corridor for transshipment of contraband from Thailand by people living in other states. 2 Having considered the gravity of the offence and the manner in which the Calcutta Airport is being used, I am not inclined to release the petitioner on bail.

Accordingly, CRM (NDPS) 1682 of 2025 is dismissed. All parties shall act in terms of server copy of the order downloaded from the official website of this Court.

Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
