Learned Senior Counsel for the petitioner by way of reply submitted that the judgments which are relied upon by the learned counsel for respondent No.2 are not applicable to the facts and circumstances of the case on the ground that the above said judgments arise under PMLA Act and as per the provisions of Section 45 of the PMLA Act, there is a specific bar to grant anticipatory bail in favour of the accused, whereas, the present crime was registered for the offences under Sections 318(4), 316(2) and 61(2) of the BNS and Section 5 of TSPDFEA. The parameters for deciding anticipatory bail application in respect of BNS offences and PMLA offences are different and distinctive.
