It is submitted by the learned counsel for the parties that the Presiding Officer has been appointed in DRT-I and the Tribunal is functional. By an order dated 02.02.2022, a Coordinate Bench of this Court had granted interim protection to the petitioners herein observing that the DRT-I is not available and the Securitisation Application No.58 of 2021 is pending for adjudication.
Now since the DRT-I is functional, the interim protection granted to the petitioners, restraining the respondent-Bank from taking possession of the mortgaged property is extended for a period of four weeks from C/SCA/2447/2022 ORDER DATED: 24/08/2022 today. The petitioners are at liberty to seek appropriate reliefs in the pending Securitisation Application before the DRT. It is made clear that this Court has not opined anything on the merits of the matter nor examined the merits of the case. The special civil application stands disposed of accordingly.
