The other aspects which really weight much to this court is that the authorities while taking such decision have found that the candidature of other thirteen candidates were cancelled on the ground of non- mentioning of the concerned Village Education Committee in the residential certificate. The court cannot shut its eyes on the ground of equality as the same is the basic structure of the Constitution. The privation of the other eligible candidates on technicality should not be encouraged. Once the authorities found that other candidates have also found deprived because of such technicalities an opportunity should be given to such candidates to be heard before taking such decision. Thus, I find that the order impugned in this writ petition does not stand on the anvil of principles of natural justice and is hereby quashed and set aside. The District Project Officer, Sarva Siksha Mission, North 24- Parganas is directed to reconsider the said issue upon giving opportunity of hearing to all the candidates whose candidatures have been directed on the ground of non- mentioning of the concerned Village Education Committee in the residential certificate and shall take the decision within four weeks from the date of communication of this order in accordance with law.
