As the defendant's product was not launched at the time of filing of the present suit and the present suit was filed as a quia timet action, the predecessor bench, on 23rd February 2024, directed the plaintiffs to do the claim mapping in respect of IN'632, the product patent, with claims of the defendant's patent application no. 2021079337. Admittedly, the product of the defendant was launched in the market in June 2024. Yet the plaintiffs have not conducted any analytical characterisation or a reverse engineering of the defendant's product to show that the defendant's product is identical, or even similar, to the plaintiffs' product manufactured using the process patent, which is a statutory requirement under section 104A of the Act.
