4. The respondent CPIO in his written submissions stated that M/s. Megacity (Bangalore) Developers & Builders Ltd. was ordered for investigation u/s235 of the Companies Act, 1956 by the Ministry vide order dated 17.4.2009 by Serious Fraud Investigation Office (SFIO). The SFIO has submitted its investigation report to the Ministry on 30.7.2011 for necessary examination and further instructions to SFIO. When the RTI application was received the investigation report was under examination in the Ministry and was under process for issue of necessary instructions to SFIO to launch prosecutions against the accused company. The Ministry of Corporate Affairs has given its approval for prosecution and a case has been filed under the Companies Act and IPC before the competent Court at Bangalore, where the case is pending trial. The respondent submits that the final decision has been taken by the Ministry to prosecute the offenders. They have no objection now in providing requisite information to the appellant.
