The next contention of Mr. Sarbadhikary, is that, the Enquiry Officer has observed that the guilt of the concerned workman was not proved beyond reasonable doubt, which was necessary for holding a person guilty of any offence under the Criminal Procedure Code. According to Mr. Sarbadhikary, the mere possibility and probability or the preponderance of evidences, showing the involvement of the concerned workman in the alleged forgery will be sufficient to hold him guilty of such forgery and according to him, the learned Tribunal ought to have held the opposite party No.1/ workman, has been proved guilty of forging signatures of Smt. Ratna Sarkar and learned Tribunal ought to have affirmed the order of the Disciplinary Authority and the Appellate Authority discharging the workman from service.
