The same question was the subject-matter of consideration by the High Court of Australia in a later case Marz v. The Queen(1). The question at issue was the validity of a conviction for rape after the accused had been acquitted on the charge of murdering the woman during the commission of the act. In a unanimous judgment by which the appeal of the accused was allowed, the High Court stated as follows :--
