1. List has been revised. Learned counsel for the petitioners is present. However, nobody is present on behalf of respondents.

2. Heard learned counsel for the petitioners.

3. The petitioners by means of the present petition have prayed for the following relief:-

"i. Issue an appropriate writ, order or direction calling for the records of the case and to set aside/quash the demand note dated 03.06.2014 and 31.05.2013 issued by the respondent no.3/ADA to the extent the same has required the petitioners to deposit external development fee by taking the value of total area as FAR.
"1. Learned Standing Counsel has accepted notice on behalf of respondent no. 1 and Sri Anoop Trivedi has accepted notice on behalf of the respondents no. 2 and 3.
2. It is contended that for calculation of external development charges Floor Area Ratio should not be a basis but it should be the total area of land. Reliance is placed on Government Order dated 29.12.2005.
3. Learned counsel for the respondents stated that Government Order dated 29.12.2005 is not applicable in this matter. He prayed for and is allowed three weeks' time to file counter affidavit. Rejoinder affidavit, if any, may be filed within one week thereafter.
4. List after expiry of aforesaid period for hearing/final disposal.
5. In the meantime, petitioner may pay entire amount as demanded by means of the demand notice but the aforesaid deposit shall be subject to result of the final decision of the present writ petition."

The present petition has been entertained on the ground that petitioner is liable to pay external development charges as per the Government Order dated 29.12.2005 which according to petitioner provides that for calculation of external development charges, Floor Area Ratio (FAR) should not be the basis, but it should be the total area of the land.

The question as to whether the Government Order dated 29.12.2005 is applicable in the facts of the present case and also the fact as to whether the external development charges has been calculated on the basis of Floor Area Ratio or on the basis of total area of land can very well be looked into by the authority concerned.

In such view of the fact, we dispose off the writ petition permitting the petitioners to file a detailed representation before the respondent no.2-Vice Chairman, Allahabad Development Authority, Allahabad within a period of one month from today. On submitting such representation, the respondent no.2 shall consider and decide the same strictly in accordance with law within a period of two months from the date of production of certified copy of this order after giving due notice and opportunity of hearing to the petitioners.
