14. Thus, all in all, when the detention order was confirmed, there was only one case in which the detenu was in custody. Such case is mentioned at serial no. 5 and even therein, he was, admittedly, released on bail as late as on 21.12.2023. Such bail was granted by learned Single Judge of this Court while observing that the case of prosecution was merely on the basis of disclosure statement of co- accused and moreover the voice sample of the accused did not match with the intercepted phone calls.
