Respondent-landlord filed a petition under Section 13 of the Haryana Urban Rent Restriction Act seeking eviction of the petitioners-tenants from the demised premises on the ground of arrears of rent. Petitioners filed reply denying the averments made in the ejectment petition.
Learned Rent Controller assessed provisional rent and fixed the case for 8.1.2016 for tendering of rent amount. On the fixed date petitioners failed to tender the arrears and hence eviction order dated 8.1.2016 was passed by Rent Controller,Panchkula. The appeal filed by petitioners-tenants was dismissed by the learned Appellate Court vide order dated 31.5.2016.Hence the present revision petition in which vide order dated 1.8.2016 notice of motion was issued and execution of the 1 of 2 order of ejectment,if not already executed,was ordered to be stayed subject to certain conditions laid down in the order dated 1.8.2016.
