6.2. Dissatisfied with the response received from the CPIO, the Appellant filed a First Appeal dated 12.08.2024. The FAA vide order dated 31.08.2024 upheld the reply given by the CPIO.

6.3. Aggrieved with the FAA's order, the Appellant approached the Commission with the instant Second Appeal dated 26.09.2024.

7. The Appellant filed an RTI application dated 15.08.2024 seeking information on the following points:

1) "Copy of written reporting exist on the record of Regional Office Sultanpur by which this was reported before the authorities of the Bank that in between 01/2/2016 and 11/9/2017 loan document nuber ******0552 was reported as a missing loan document but RM Sultanpur is not providing that reporting to manager C.R.Goklani EC 1027. In the said matter of defective and prejudiced working of the Baroda U.P.Bank, a complaint matter number BUPGB/Complaint/3346 dated 21/6/2024, addressed to General Manager ( Complaint matters ) was posted / sent on official E-Mail ID [email protected] of the Bank on 21/6/2024 at about 11.33 am. Complaint document does exist in material form on the records of the office of the General Manager ( Complaint matters ) Head Office. PDF copy of mail sent item of Complaint is enclosed.
1.3 Provide attested copy of the Complaint letter with every official noting marked on it by designated official.

Provide complete Action Taken Report prepared by the General Manager ( Complaint matters ) office of the Bank, in the matter of complaint letter number BUPGB/Complaint/3346, of retired manager C.R.Goklani, sent on 21/6/2024 through E-Mail ID *****[email protected] on the official E-Mail ID [email protected] of the Baroda U.P.Bank, 2.2 Provide name, designation, EC number E-Mail ID and mobile number of the concerned officer of the who has officially been assigned / designated with the job to take appropriate action and to deal with above mentioned complaint matter BUPGB/Complaint/3346, of C.R.Goklani and who may provide latest updates of said complaint.

4) On the official record of Regional Office Sultanpur, every official paper / document / record related with the reported missing incident of loan document number **********0552 does exist in material form with Vigilance Department of Regional Office Sultanpur.

Under section (2) (j) (1) of the RTI Act 2005 provide inspection of that particular file in which every official paper / document / record related with the reported missing incident of loan document number **********0552 are filed and kept with Vigilance Department of Regional Office Sultanpur. Inspection requested on point number (4) of present RTI application is not covered by exemption provided under section (8) (1) e, j of the RTI Act 2005. Inspection of official records requested on point number ( 4 ) of present RTI application was never been provided In the past to the RTI applicant.

Under section (2) (j) (1) of the RTI Act 2005 provide inspection of that particular document of the Bank by which official Preliminary investigation was ordered in between 01/2/2016 and 20/6/2019 by Regional Manager Sultanpur in the matter of reported missing incident of loan document number **********0552 of Garavpur branch.

Purpose of requesting this information is to know about the date on which loan document number **********0552 of Garavpur branch was reported as a missing loan document and to know about the date on which on the record of the Bank due Preliminary investigation was ordered by Regional Manager Sultanpur. Beyond the legal exemptions provided under section (8) (1) of the RTI Act 2005, CPIO has no other legal reason / legal way to reject the RTI request point number (3) of present RTI application.
