2. Facts leading to the above petitions:

2.1. The Petitioner claims to be the Managing Director of a Private Limited Company viz., Dream Logistics Company having its office at the address stated in the cause title viz., Iron Ore Stock Yard, Aligadda, Karwar Taluk, Uttara Kannada District and registered office at Dream Chambers, Near Bus Stand, Yellapur, Uttara Kannada District.
2.2. The Petitioner is engaged in the trade and business of exporting iron ore from Karwar Port and other Ports in India. The Petitioner has obtained Certificate of Importer-Exporter Code (IEC) from the Ministry of Commerce, Government of India on 25.07.2005. In CRL.P. NO.101728 OF 2017 pursuance thereof, the Petitioner was exporting iron ore through Cargo Ships to China, which is used as raw material for the production of steel and other iron allied products.

4.18. The manner in which the Petitioner has represented itself, it is not clear whether it is a limited company or not. In fact, even in the causetitle as also in the Certificate of Importer and Exporter Code, the name is shown as Dream Logistics Co, which could only signify the same to be either a CRL.P. NO.101728 OF 2017 proprietory concern or a partnership concern. In either case, both the proprietor or partner are responsible. It is only now for the first time that the Petitioner has sought to contend that it is a Private Limited Company. If at all, it is so, then there is a further misrepresentation made by the Petitioner since it is held out to be a proprietary concern and/or partnership firm. Infact, even in the petition filed, it is stated that the Petitioner is stated to be the Managing Director of a Private Limited Company whereas the causetitle only shows the Petitioner to be a Dream Logistic Co. He submitted that on the basis of the above that the Petitioner has been misrepresenting and making all these false allegations only to try and escape its liability.
