In the complaint filed by respondent No.2 before the State Consumer Disputes Redressal Commission, the company took a stand that the transaction between the parties was pursuant to a contract and that it had acted as per the contract and that there was no deficiency in service. It was also pleaded, in the alternative, that highly disputed questions of fact arose for consideration and that under the summary jurisdiction the Commission should not adjudicate thereupon.
