The case of the petitioner is that he applied for the post of Laboratory Assistant on 02.04.2015 under the BC non priority category and having participated in the written examination secured 120 marks but the last person selected in that category has secured 121 marks. But now the petitioner has obtained information under the Right to Information Act that still eight vacancies are available in BC category and the same is yet to be fill up and hence, came forward to file this writ petition seeking for a direction to the respondents to appoint him as Laboratory Assistant.

Since the petitioner's case is not coming within the BC communal rotation, for which the posts vacant are meant for and no material is also produced before this Court indicating the fact that any person belonging to BC non priority category, who secured less mark or equal mark has been selected, ignoring the case of the petitioner, this Court is of the view that the petitioner has made out no case and accordingly, the writ petition filed by the petitioner stands dismissed at the stage of admission. No costs. Consequently, the connected miscellaneous petition is also closed.
