These Criminal Petitions are filed under Section 438 of the Code of Criminal Procedure, 1973 (for short "Cr.P.C.") to enlarge the petitioner on bail in the event of his arrest in connection with crime No.126 2022 of Amalapuram Taluqa Police Station and Crime No.139 of 2022 of Amalapuram Town Police Station, East Godavari District.

2. The petitioner is arrayed as accused Nos.243 and 247 in the above crimes.

3. Crime No.126 of 2022 is registered for the offences punishable under Sections 143, 144, 147, 148, 151, 155, 452, 436, 353, 332, 427, 188, 307 r/w 149 of the Indian Penal Code, Sections 3 & 4 of PDPPA, Section 3(2)(v), 3(2)(va) of SC & ST (POA) Amendment Act, 2015.

4. Crime No.139 of 2022 is registered for the offences punishable under Sections 307, 143, 144, 147, 148, 151, 152, 332, 336, 427, 188, 353, 324, 435 read with 149 of IPC, Sections 3 and 4 of PDPP Act and 32 of Police Act, 1861.

5. Basing on the reports lodged by Sub-Inspector of Police, Crime No.126 of 2022 and basing on complaint lodged by the Village Revenue Officer of the 30th ward, Amalapuram Town, Crime No.139 of 2022 was registered.

6. The facts of above crime are inter-linked. Therefore, they are considered and decided by this common order.

22. Further it appears that basing on confession of other accused, petitioner was arrayed as accused in the above crimes.

23. Considering the above facts and as no specific overt acts are made against the petitioner and petitioner, this Court deems it (1998) 8 SCC 130 appropriate to grant pre-arrest bail to the petitioner on the following conditions.

1) The petitioner who is arrayed as A-243 in crime No. 126 of 2022 of Amalapuram Taluq Police Station and A-247 in Crime No.139 of 2022 of Amalapuram Town Police Station, East Godavari District shall be released on bail in the event of his arrest in connection with said crimes on condition of executing self bond for Rs.20,000/- (Rupees Twenty Thousand only) with two sureties for a like sum each, in each crime to the satisfaction of the Station House Officer, Amalapuram Taluq Police Station/Amalapuram Town Police Station, East Godavari District.

2) The petitioner shall appear before the Station House Officer, Amalapuram Taluq Police Station/Amalapuram Town Police Station, East Godavari District once in a week i.e. on every Saturday between 9:00 am to 6:00 pm, twice in a week i.e. on every Monday and Thursday between 9.00 AM and 12.00 noon, till filing of the charge sheet; and

3) The petitioner shall not directly or indirectly contact the complainant or any other witnesses under any circumstances and any such attempt shall be construed as an attempt of influencing the witnesses and shall not tamper the evidence and shall co-operate with the investigation. Further, the petitioner shall scrupulously comply with the above conditions and any infraction of the same will be viewed seriously and bail automatically gets cancelled without any further order of this Court.
