8. The prosecution case is that PW-6 S.B. Sinha was entrusted to lay a trap. A raiding party was formed in which he joined two independent witnesses Baldev Khera and B.K. Agnihotri and at about 4.30 pm all the trap team members alongwith the independent witnesses left CBI office and came to the spot at Janpath near Florist Shop. PW-2 Baldev Khera was instructed to act as a shadow witness and to overhear the conversation of S.K. Bhatia, A.K. Goel and S.S. Sanan and pass on a signal after the transaction of bribe is complete.
(iv) PW-4 S.L. Kanojia was Income Tax Officer and he was working as Drawing and Disbursing Officer (DDO) in the Department of Income Tax. He has proved the relevant file maintained in the office of Income Tax relating to the matter of issuing of 'NOC' in the present case as Ex.PW4/1 and has also proved the valuation report as Ex.PW4/2.
(v) PW-5 Dharam Pal Satya was an employee in the office of Appropriate Authority Income Tax Department during the relevant period.
(vi). PW-6 S.B. Sinha is trap laying officer.
28. To prove the trap and its case in this regard the prosecution has been relying upon the statement of PW-2 Baldev Khera and also upon the statement of PW-6 S.B. Sinha, PW-8 S.K. Peshin, PW-9 Inspector Rajesh and PW-10 DSP Ramnish who were members members of the trap team alongwith PW-6 S.B. Sinha.

The defence has taken a plea that no credence may be given to the statement of PW-6 and other members of the trap team as they are interested witnesses and moreover according to the defence counsel their statement cannot be believed for the reason that independent witness PW-2 Baldev Khera has not supported CBI Vs. S.K. Bhatia Etc. AC No.26/11/96 RC No.34(A)/95 them and other independent witness B.K. Agnihotri has not been examined.
30. PW-6 S.B. Sinha is TLO. He deposed that on 8.5.95 FIR (D-1) Ex.PW6/1 was registered upon source information. As per PW-6 he formed a raiding party, joined PW-8, PW-9 and PW-10 and other staff and also joined PW-2 Baldev Khera and B.K. Agnihotri. As per PW-6 they reached the spot at about 5.05 pm and at about 5.45 pm A1 S.K. Bhatia arrived and also within ten minutes of that A3 A.K. Goel and A4 S.S. Sanan also arrived with bribe amount kept in a cloth bag. As per PW-6 after receiving signal from PW-2 they apprehended A1, A3 and A4 and from the possession of A1 S.K. Bhatia recovered number of files including file no. 4433 of Income Tax Office brought by A1 and also total amount of Rs. 3.5 lac which include bribe amount of Rs. 3 lac as involved in this case handed over to him by A3 and A4 at the spot.
