46. Section 152 of the Code of Civil Procedure has been the subject matter of various decisions referred to above. Let us discuss the said decisions.

47. In Udhishter Singh case (supra), properties mortgaged to the prior mortgagee as well as to the subsequent mortgages were mentioned in the preliminary decree. However, certain additional properties mortgaged to the prior mortgagee (but not mortgaged to the subsequent mortgages) were not mentioned in the preliminary decree. The question was whether such additional properties could be mentioned in the final decree, even though the same were not mentioned in the preliminary decree.
