Further during the examination of PW-6, one Sh. Durganand Jha, LDC Bihar School Examination Board Patna, Bihar appeared in the court along with original record i.e. original verification file and original tabulation register relating to result of Secondary School Examination (Matric), of the annual examination of the year 1989 in sealed condition. The seal was opened and found containing the original tabulation register relating to the centre codes 7320-7321 and 7323. Photocopy of relevant FIR No. 322/2004 Page no. 4 of 23 portion of tabulation register relating to the above said examination centre having code 07323 roll, no. 0436 of Secondary School Examination (Matric) Annual 1989 was taken on record as Ex. PW- 6/A(OSR). The original file also contained carbon copy of letter no.226 dated 11/02/2004 addressed to Sh. K.C. Dwivedi, Deputy Commissioner of Police, Vigilance, Delhi whereby it was reported by the board that the educational documents pertaining to the present accused Murarji Mishra were found to be not genuine upon verification with records. Photocopy of the same was taken on record as Ex-PW6/B (OSR). The witness was cross examined at length by ld counsel for the accused in regards to the report of verification and the manner in which the record were maintained by the board.

FIR No. 322/2004 Page no. 17 of 23 Moreover, the said candidate namely Ram Bihari Pandey who had appeared at examination centre having code no. 07323 vide roll. no. 0436) was also declared as FAILED, thereby clearly indicating that the educational documents and mark sheet purported to be issued by Bihar School Examination Board, Patna by the present accused Murari Jee Mishra are forged and fabricated.

33. Further during the examination of PW-6, one Sh. Durganand Jha, LDC Bihar School Examination Board Patna, Bihar appeared in the court along with original record i.e. original verification file and original tabulation register relating to result of Secondary School Examination (Matric), of the annual examination of the year 1989 in a sealed condition. The seal was opened and found containing the original tabulation register relating to the Centre codes 7320-7321 and 7323. Photocopy of relevant portion of tabulation register relating to the above said examination Centre having code 07323 roll, no. 0436 of Secondary School Examination (Matric) Annual 1989 was taken on record as Ex. PW- 6/A(OSR). It is clear from the said tabluation register Ex. PW- 6/A(OSR) that one Ram Bihari Pandey S/o Sh. Baliram Pandey had appeared at examination centre having code no. 07323 with roll. no. 0436 and not the present accused. It is further revealed through Ex. PW-6/A(OSR) that the said candidate namely Bihari Pandey S/o Sh. Baliram Pandey as well was not able to secure minimum passing marks in the examination and thus he too was declared as Failed.

In light of testimony of PW-6 and the record brought by him i.e. the Tabulation register Ex PW6/A(OSR) as per which one Ram Bihari Pandey had appeared in Secondary School Examination (Matric) conducted by Bihar Educational Board, Patna in the year 1989 against Roll code 07323 and Roll no. 0436 and failed in the examination, it stands duly proved that documents Mark A1 to A4 i.e. High School certificate and mark sheet reflecting that the present accused Murari Jee Mishra appeared with Roll code 07323, Roll no. 0436, certificate no. 89C 330654 dated 21.09.1989 in Secondary School Examination (Matric) and duly passed the same, are forged. Consequently the School Leaving Certificate from Shri Ganpath Chakni Uuch Vidyalaya Hateel Pur, Bhoj Pur (Mark A1) is also established to be forged.
