The legal sustainability of the impugned order passed under Section 15 of the BBC Act directing the defendant to pay the petitioner arrears of rent as well as current rent has been questioned in this application under Article 227 of the Constitution of India.
After considering the submissions and materials on Patna High Court CWJC No.15555 of 2013 dt.19-01-2017 2 record including the impugned order, this Court does not find that the court below has committed illegality and material irregularity in passing the impugned order justifying the interference under Article 227 of the Constitution of India.
