III. Learned Court below misdirected itself in not taking into account the Schedule -III appended to Act of 1925 and also in not considering that Section 250 of Act of 1925 applies when a person dies, leaving property of which he was sole or surviving trustee or in which he had no beneficial interest on his account, and leaves no general representative, or one who is unable or unwilling to act as such, letters of administration, limited to such property, may be granted to the beneficiary, or to some other person on his behalf. Testator happened to be one of the trustees/shebaits in respect of the trust property and hence, provisions of Section 250 of Act of 1925 has no manner of application in the case at hand. Query no. 3 is answered accordingly.
