For the Opposite Party The petitioners upon payment of Rs.40,000/- on or before 15th May, 2012 would be entitled to an order of stay of execution proceeding arising out of ejectment case no. 450/04 till the disposal of the appeal pending before the Additional District Judge at Sealdah. There shall be however, unconditional stay of the execution proceeding till 15th May, 2012. After the expiry of 15th May, 2012, it is expected that the Court would proceed with the appeal as expeditiously as possible keeping in mind that the ejectment suit was instituted in the year 2004 and a decree was passed on 26th September, 2011. It is needless to mention that the Court will not grant any unnecessary adjournments to either of the parties and decide the appeal on merit and in accordance with law being uninfluenced by the observations made by this Court.
