The said termination/discharge gave rise to a labour dispute raising the following issue;
"Whether the termination of services of Shri MunshiRam was justified and in order? If not, to what relief he is entitled?"
The Labour Court by its order dated 19.06.1982 made an award holding that the termination was neither justified nor in order and the workman is entitled to reinstatement with continuity of services and with full back wages. The said award came to be challenged in the Writ Petition before a learned Single Judge of the High Court of Punjab & Haryana at Chandigarh. The learned Single Judge by his order dated 30.08.1991 allowed the writ petition and set aside the award of the Labour Court. While doing so, it observed;
