(iii) that the Supreme Court in the mater of Mallikarjun Kodagali (supra) had an opportunity to relook at the proviso to section 372; that in the said matter after recognizing the plight of the victims of crime, the Hon'ble Supreme Court also recognized the need to provide meaningful rights to the victims of an offence and the need to consider giving a hearing to the victim while awarding the sentence to a convict; that a victim impact statement or a victim impact assessment must be given due recognition so that an appropriate punishment is awarded to the convict; that the Supreme Court also recognized that the proviso to Section 372 Cr.P.C. must be given a meaning that is realistic, liberal, progressive and beneficial to the victim of an offence. It is in light of these findings that the Hon'ble Supreme Court in Mallikarjun Kodagali (supra) held as under:-
