13. In Maruti Ram Naik Vs. State of Maharashtra (supra), there was delay in recording the statement of the injured witness. In the facts of that case, the Apex Court has held that delay in recording the statement was fatal. In Jagjit Singh Vs. State of Punjab (supra), there was delay of three days in recording the statement of independent witnesses. In Balakrushna Swain Vs. State of Orissa (supra), evidences of witnesses were not recorded by the Investigating Officer for a number of days.
