1. This petition has been filed under Section 482 Cr.P.C for quashing of Cr. Case No.115/2018, State Vs. Vishal & Others, pending in the court of Additional Chief Judicial Magistrate No.1, Jaipur District, Jaipur arising out FIR No.13/2016 registered at (2 of 2) [CRLMP-5884/2021] Police Station Moti Doongari, Jaipur City (East) for the offences under Sections 147, 323, 341 IPC and Section ¾ of the Rajasthan Medical Attendance Act, 2008.

2. Heard Learned counsel for both the sides and perused the material available on record.

Learned counsel appearing for both the sides have submitted that compromise has been arrived at between the parties and on the basis of which the accused petitioners have been acquitted by the trial court for offence under Sections 323 and 341 IPC and trial under Section 147 IPC and ¾ of the Rajasthan Medical Attendance Act, 2008 has been directed to continue. The dispute is purely of a private nature between the parties now they have amicably settled all their disputes, therefore, the present criminal proceedings may be quashed in view of the legal position expounded in Gian Singh Vs. State of Punjab & Another [(2012) 10 SCC 303].

4. Learned Public Prosecutor submits for appropriate directions.

In view of the above legal position and to secure the ends of justice, being the dispute private in nature, this petition is allowed and the proceedings in above Criminal Case No.115/2018, State Vs. Vishal & Others, pending in the court of Additional Chief Judicial Magistrate No.1, Jaipur District, Jaipaur pending for the offences under Section 147 IPC and ¾ of the Rajsthan Medical Attendance Act are hereby quashed.
