45. The contention of the counsel for the plaintiffs that the previous chain of sale documents namely Notarised GPA executed by Smt. Sarjo Devi, mother of plaintiff nos. 1 & 2 in favour of Smt. Chandrawati is not on record, therefore, this missing link in the sale documents of defendant no. 1 is fatal to the case of defendant is devoid of force in as much as on the basis of Notarized GPA Smt. Chaderwati has executed registered GPA in favour of DW­4, Sh. Sukhbir Shokeen and DW­4 has deposed in categoric terms that he has seen the said Notarized GPA executed in favour of Smt. Chanderwati by Smt. Sarjo Devi therefore, the said missing links in the chain of missing documents is not going to demolish the claims of the defendant no. 1 over the suit property. Suffice is to that the reliance placed upon Roop Singh (dead) Through LRs v. Ram Singh (Dead), AIR 200 SC 1485, the judgment dated CS No. 151/2016 Preet Singh & Ors. v. Sunita Devi & Ors Date of Decision : 17.02.2020 28.03.2000 passed by Hon'ble Supreme Court of India, in as much as in the said case the plea of adverse possession and the doctrine of part performance were found to be inconsistent with each other and defendant (therein) was not found entitled to raise the plea of adverse possession and as such the facts of this case stands distinguished from the facts of the present suit.
