In brief, facts of the case are that the respondent- complainant filed above mentioned complaint of defamation against the petitioner-accused under Section 500 IPC with the averments that the CRM-M-31268-2014 petitioner-accused filed a complaint under Section 500 IPC against some employees of Civil Surgeon Office at Hoshiarpur in which summoning order was passed. In that complaint, the complainant herein stood surety for one of the summoned person. The accused got furious with the act of the complainant herein and started pressurizing him to withdraw his surety, but he declined the same. Thereafter, the accused used abusive language and threatened the complainant with dire consequences. The accused used to file false complaints with malafide intention to harass the complainant herein. The accused filed complaint against the complainant by using fictitious name and levelled false allegations as under:

CRM-M-31268-2014 The accused distributed the copies of complaints to common friends of complainant and delivered defamatory remarks towards the character of the complainant. On 08.06.2013, the accused reached in ESI Dispensary Nasrala-I, Hoshiarpur and used abusive language with the complainant. Due to the false allegations levelled by the accused, the complainant had to face departmental inquiry. The complainant faced humiliation, felt insulted due to the illegal and defamatory act of the accused. The accused also reached the house of complainant in his absence and intentionally used abusive language and passed defamatory remarks. The accused delivered defamatory speeches, words i.e thief, dishonest man against the complainant and that the complainant used to take bribe from people etc. etc. All this has been done with malafide intention to defame, humiliate, insult the complainant in the eyes of right thinking people of society at large.
