The essential issues raised in this case are about the appointment of a third party to digitally evaluate the answer scripts; the methodology that is adopted by them for the purpose of selecting this agency and their experience in evaluation of such papers. It is also clear that as a State instrumentality, "APPSC" has to act as mandated by law.

With these observations, the following prima facie conclusions are being reached at this stage. These conclusions, in the opinion of the Court, make it clear that they are seriously triable issues and matters which need to be heard at greater length.
