Heard learned counsel for the applicant, learned AGA for the State and perused the material on record.

This criminal misc. application U/s 482 Cr.P.C. is filed to set aside the order of non-bailable warrant dated 15.12.2021 as well as proceeding under Section 82, 83 Cr.P.C. dated 27.05.2022 issued by Additional Chief Judicial Magistrate, Firozabad, in Case No. 6245 of 2015 (State vs. Shankar Lal and others), arising out of Case Crime No. 570 of 2015, under Sections 420, 467, 468, 471 IPC, P.S. South, District Firozabad.

The submission of learned counsel for the applicant is that applicant was on bail vide order dated 16.12.2015 of this Court. During course of trial, applicant could not appear before the court below on 15.12.2021 and non-bailable warrant has been issued against the accused applicant and thereafter on 27.05.2022 process under Section 82/83 Cr.P.C. has been issued against the applicant. Learned counsel for the applicant submitted that applicant is ready and willing to appear before the court below and seek bail. Learned counsel for applicant further submitted that a direction be issued for expeditious disposal of bail application.

However considering the rival submissions of the parties, it is provided that applicant may appear/surrender before the court below within a period of two weeks from today and move bail application. If such, any application is moved, it shall be decided expeditiously and according to settled principle of law.

For a period of two weeks, the non-bailable warrant and process under Section 82/83 Cr.P.C. shall be kept in abeyance, if not executed yet.

With the aforesaid directions, the application is disposed of.
