Qua the claim of he petitioners claiming appointment on the basis of waiting list, it deserves to be noticed that there is a provision for preparation of waiting list to the extent of 20% of the advertised posts. The standing order itself makes a provision for making appointments from the waiting list, till the process of selection is complete. It has further been prescribed that process of selection shall be deemed to be complete on completion of 180 days from the date of declaration of final result. Hence, but for the intervention by this court through the interim orders, these persons would have been entitled for consideration for appointment in accordance with their merit. Accordingly, the respondents themselves have undertaken that the cases of the petitioners who are in waiting list would be considered for appointment against the posts left vacant due to non-joining of the candidates or occurring due to termination of service of such persons whose licenses have been found to be fake or not genuine. Accordingly, this group of writ petitions deserves to be disposed of with a direction to the respondents to consider the petitioners in the waiting list for their appointment to above mentioned vacant posts, in accordance with their merit.
