3. The petitioner is aggrieved by order dated 1.7.2014 whereby respondent No.1 Collector has directed that common plot in the cooperative housing society should not be used or allowed to be used for commercial purpose.
4. Aggrieved by the said order, the petitioner has taken out present petition.
5. Learned advocate for the petitioner assailed the order on ground of violation of principles of natural justice. She submitted that after considering the complaint filed by one of the members of the society against commercial use of the common plot of cooperative housing society, on one hand respondent No.1 Collector issued showcause notice to respondent No.2 society and on the other hand, the respondent No.1 Collector, on the same day, passed order of even date and restrained the use of the society's common plot. She also submitted that the Board of Nominee has also passed certain orders and according to the petitioner.

From the submissions by learned advocate for the petitioner and from the material on record, more particularly from the impugned order by the Collector, it appears that on receipt of complaint by one of the members of the petitioner society alleging, inter alia, that the common plot of the society was being used for commercial purpose in violation of Section 67 of the Code, the Collector had caused an inquiry by Circle Officer from the office of Mamlatdar. It has also emerged that on inquiry, the concerned Officer submitted a report that in the common plot of the cooperative society, a caterer namely, Patel Caterers, has constructed a shed admeasuring about 12x12 ft. where the material used by the caterer is stored and the conference room of the cooperative society is being used as kitchen by the said caterer. The said officer reported that the plot was being used for commercial purpose and it, prima facie, appears that such use would constitute breach of Section 67 of the Code.
9. In view of the said report, the Collector issued show cause notice dated 1.7.2004 and asked the cooperative society to submit a reply / explanation within 7 days. By the said show cause notice, the Collector also informed the petitioner society that, in the event of failure or default in submitting the reply, appropriate further proceedings will be instituted.
10. By a separate order of even date, the Collector also restrained the society from using the common plot for commercial purpose. In the said separate order, the Collector has expressly mentioned that in light of the report of the Circle Officer, it, prima facie, appears that common plot is put to use for commercial purpose which, if established, would invite action under Section 67. the said order is required to be read along with and in conjunction rates of even date. When the show cause notice and the order are read conjointly, it becomes clear that the order is an adinterim or interim direction passed by the Collector until the reply / explanation is received and further decision after hearing the society is taken. The petitioner, however, would contend that the impugned order is passed separately and on the same date, when the show cause notice asking the petitioner to file the reply was issued. Merely because the Collector passed separate order and directed the society to stop commercial use of the common plot, it cannot be said that the Collector has passed final order and close the chapter without acting in furtherance of the show cause notice dated 1.7.2014. The direction contained under order dated 1.7.2014 has to be read in conjunction with the show cause notice. Accordingly, it means that the direction is in nature and by way of ad interim or interim direction pending further hearing and proceedings in connection with and pursuant to the show cause notice of even date.
