1. The appellant filed an application under the Right to Information Act, 2005 (RTI Act) before the Central Public Information Officer (CPIO), Union Bank of India, Andheri (E) Branch, Mumbai seeking information on 40 points pertaining to an account of M/s Zoom Vallabh Steel Ltd., Dugdha, including, inter-alia, (i) loan amount sanctioned to Zoom Developers along with the date of sanction and name of the competent authority sanctioning it, and (ii) terms and conditions of the loan.
2. The appellant filed a second appeal before the Commission on the grounds that the CPIO has only given a partial reply to his RTI application and has malafidely denied the information sought for. Moreover, the FAA did not adjudicate upon his first appeal. He contended that he, amongst others, was a permanent employee of Zoom Vallabh Steel Ltd. which was debt ridden and he was laid off after acquisition of the company. The appellant requested the Commission to direct the respondent to provide him complete, point-wise information, to impose penalty upon the CPIO and to take necessary action against the respondent for failing to furnish the information.

3. The appellant was not present despite notice. The respondent Shri Atul Kr. Khatri, Chief Manager (Law), Union Bank of India, Mumbai, attended the hearing through video-conferencing.
4. The respondent submitted that the appellant has sought information pertaining to the account of a third party, M/s Zoom Developers, which is held by the Bank in a fiduciary capacity. Further, the appellant has also sought, inter-alia, information which is in the nature of 'query', seeking explanation/clarifications from the CPIO which does not fall within the definition of 'information' as per Section 2(f) of the RTI Act. He, however, submitted that the appellant had exceeded the word limit in his RTI application of 500 words as prescribed in the RTI Rules 2012. Hence, the CPIO vide reply dated 29.06.2017 has furnished point- wise reply to point nos. 1 to 12 of the RTI application.
