2Learned senior advocate for the petitioners draws the attention of the Court to the various irregulations and violations thereof by the respondent nos. 9 to 12. He submits that, the nature of business carried out by the respondent nos. 9 to 12 are illegal. Such business affects the rights of the petitioners. He draws the attention of the Court to the judgment and order dated December 12, 2018 passed by the Madras High Court in W.P. 28716 of 2018 (The Tamil Nadu Chemists and Druggists Association Vs. The Union of India & Ors.) and to the order of the Appeal Court of the Madras High Court dated January 2, 2019.
The prayer for interim order is opposed on behalf of the respondent nos. 9 to 11.
Learned senior advocate for the respondent no. 11 submits that, the writ petitioners have no locus to maintain the writ petition.
It appears that, the Madras High Court in The Tamil Nadu Chemists and Druggists Association (supra) passed an interim order restraining conduct of commerce based on technology. A limited stay of the injunction was granted in such judgment and order. The Appeal Court was also granted a stay of the order of injunction passed in the Tamil Nadu Chemists and Druggists Association (supra) by the judgment and order dated January 2, 2019.
