3. As per FIR version, all the accused (applicants herein) have badly pounded Amit Rawat and Sahavag Rawat inflicting severe injuries.
4. It has been submitted that false and malicious prosecution has been instituted against the present applicants showing occurrence of crime which, in fact, has not been committed by the present applicants. It is further submitted that medical report of Trauma Centre, Varanasi is a procured document which cannot be relied upon for the purpose of ascertaining the veracity of the injuries shown to be inflicted on the victims (injured).
