Respondent: G Jeysi Mahil, DGM & CPIO, present over VC Information Sought:

The Appellant in her second appeal has sought information on point no.5 and 6 of the RTI application, which are stated below:

5. Copy of absentee statement of the appellant given by DET, Neyyattinkara through "TVM SSA net absentee statement portal" for the months of May and June 2018.

6. Copy of absentee statement of the appellant given by DGM (Marketing) through "TVM SSA net absentee statement portal" for the month of November and December 2018.

Grounds for Appeal The CPIO did not provide the desired information on point 5 and 6 of the RTI application.

Submissions made by Appellant and Respondent during Hearing:

The appellant submitted that she is not satisfied with the reply of the CPIO on points no. 5 & 6 as the information was provided to her from ERP ESS portal report and not from the BA net Absentee Statement as requested by her and the statement for the month of June for point no. 6 is marked as no such record which is not factually correct.

The CPIO submitted that an appropriate reply was given to the appellant on 16.03.2021. He also referred to his written submissions dated 25.10.2022.

Observations:

From a perusal of the relevant case records, it is noted that the appellant is aggrieved as according to her the information provided on point no. 5 is not what was sought by her and for the months of June, November & December, 2018, it was stated that no such record is available which is not correct. It is further noted that the CPIO in her written submissions dated 25.10.2022 has informed that the information provided was the absentee statement from BA net (1) and not that of ESS portal. She has also stated that the Controlling Officer has not made any entries in the Absentee statement for the month of June 2018 and November and December 2018. Hence no statement is available for the months of June, November & December, 2018 and the reply was given accordingly.
