Now all these clauses deal with something which is to be done in future & the use of the words "Union & every State" can be referable to judicial acts performed after the Union or States came into existence. And even Clause 3 must be applicable to parts of territories of India and Part B States have become parts of India as a result of the Constitution and not because of the Instruments of Accession or the Covenants as given in the white paper or Indian States.
