Though it is the contention of the 2nd defendant that in her mother's 16th ceremony, family arrangement was made in the presence of paternal uncle, one Manikavasagam, to establish the same, no oral and documentary evidence was adduced by him. The said Manikavasagam has not been examined. Further, the stand taken by the 2nd defendant in the cross examination of P.W.1 was that such settlement was signed in the presence pf Manikavasagam. In this regard, the order passed by this Court, which is marked as Ex.P44, clearly indicate that the alleged documents were already handed over to the 2nd defendant and 3rd defendant and he had also filed a complaint for missing documents. The above stand of the 2nd defendant is falsified in view of the order passed by this Court as early as on 13.3.2008. D.W.1 and 3 has not even contested the matter and even in the suit for partition, they have not adduced any evidence. The 2nd defendant has also not adduced any evidence.
