5. When this matter was taken in an appeal to the appellate authority (AA), Maj Gen Gautam Dutt, the following decision was taken by him:

1 (a) The proceeding/documents/records based on which decision for posting to GE, second/third time GE, are being considered by a board/individual, based on which, I was debarred from second tenure after giving beyond expected result. Ans: For second tenure GE a selection panel is made which also includes the extract of ACR grading of the individual Since ACR is a confidential document and has no relationship to any public activity the proceedings/note cannot be provided.
