ORDER
This criminal original petition is filed seeking police protection to the petitioner's life and liberty, by considering his complaint dated 25.09.2025.
2. The case of the petitioner is that he is a senior citizen and a permanent resident of Kammapuram Village, Virudhachalam Taluk, Cuddalore. On 18.05.2022, when the petitioner was doing household work at his house at U.Athanur, the 4th respondent, along with other assailants, came to his house and attacked him with lethal weapons and kidnapped him at knife point.

3. It is his further case that his daughter had immediately informed the Superintendent of Police, over phone and the petitioner was rescued from captivity. Since no case was filed, the petitioner was constrained to file a petition in Crl.M.P.No.1513 of 2022, before the Judicial Magistrate II, Virudhachalam, under Section 156 (3) of the Criminal Procedure Code, and on the direction of the learned Judicial Magistrate, a case in Crime No.312 of 2022 was registered, against the 4th respondent on 17.07.2022.

It is the further case of the petitioner that the 4th respondent had been continuously harassing him on various occasions and the petitioner has given several complaints and the official respondents, instead of registering a case, had conducted enquiry in CSR.Nos.148/2022, 312/2022, 277/2024, 422/2025 and 524/2025. The learned Government Advocate (Criminal Side), would submit that the 4th respondent was working under the petitioner and that he has borrowed money from the petitioner and there appears to be a money dispute between them. He would further submit that, earlier a case in Crime No.312 of 2022 was registered on 17.07.2020, against the 4th respondent. However, after enquiry, the case had been closed as 'mistake of fact'.
6. He would further submit that the petitioner has given several complaints and enquiry had been conducted in those complaints, which reflected that there was money dispute between the parties. He would further submit that, lastly, on 26.10.2025, the petitioner had given a complaint against the 4th respondent, based on which a case in FIR.No.150 of 2025, has been filed by the 3 rd respondent for offences under Section 296 (b) and 126 (2) of BNS. He would further submit that the respondents are conducting investigation and they will be filing a final report.
