Prayer in the present petition is for issuance of appropriate directions to the Executing Court to decide the execution application despite passing of the judgment and decree dated 16.05.2014, whereby, the ejectment order against the respondent- judgment debtors, has been passed.

Mr. B.S.Walia, learned counsel appearing on behalf of the petitioner submits that in execution petition, tenant filed objections which are stated to be pending, though the order of eviction has attained finality. He further submits that petitioner has also made a specific statement that he will take the possession of the demised portion measuring 12'x52-1/2' only and will raise separate wall within her portion. As per zimni orders, Annexure P-4, the litigation is being Civil Revision No.1540 of 2016 (O&M) {2} prolonged at the behest of the respondents.
