"The present suit under Order XXI, Rule 103, Civil Procedure Code, is of that nature being, in our opinion, practically a continuation of the proceedings before the Execution Court, wherein the transferor and his representatives succeeded in ejecting Mt. Firadus Jehan from possession which she had originally taken in pursuance of the contract of purchase....in both cases the object of the suit is to protect possession and the capacity in which the plaintiff comes to Court is, in reality, one of defence."
