Further, the trial court has referred to the documents procured by the plaintiff-petitioners under the Right to Information Act from the office of the Deputy Registrar, Firms, Societies and Chits, which allegedly show that the Board of the Welfare Association is not registered and, therefore, the present Board has no authority to question the NOC issued in favour of the plaintiff-petitioners. In my opinion, such an observation is completely arbitrary and illegal, as on coming to such a finding, the first question that ought to have arisen was whether the suit would be defeated for non-joinder of necessary parties.
